Accessibility law for Dutch public bodies
From EU directive to Dutch decree
The Web Accessibility Directive (2016/2102) is implemented in the Netherlands through the Besluit digitale toegankelijkheid overheid (BDTO), anchored in the Wet digitale overheid since 1 July 2023.
Purpose and scope
The decree requires every public body and semi-public organisation to make its websites and mobile apps accessible, so that everyone can take part in the digital society.
What it covers
The accessibility requirements apply to:
- Web-based information and interaction services
- Online transactions and participation platforms
- New procurement projects
- Existing digital services
- Mobile applications
- PDF documents and other downloadable files
The standard
The standard is EN 301 549, which today references WCAG 2.1 level A and AA; WCAG 2.2 follows once EN 301 549 V4.1.1 is cited in the Official Journal of the EU. We audit against WCAG 2.2 AA, which covers 2.1. Start with a WCAG-EM audit: it is the basis for the accessibility statement.
Your action plan
Every website and app needs a published accessibility statement (toegankelijkheidsverklaring) that states its conformity status, is based on an evaluation and is updated at least once a year. The statement is registered in the national register at DigiToegankelijk.
The register in numbers
On 24 September 2026 the DigiToegankelijk dashboard listed 9,110 registered websites and apps, 36% of which had status D or E: the requirements are not yet met or there is no valid statement. Open the DigiToegankelijk dashboard (opens in a new tab)
